1. The Enforcement Mechanism
The Solid Waste Management Rules, 2026 replace the old "nominal fine" system with the "Polluter Pays" Principle.
- Tier 1 (Local): Municipal officers issue immediate "Spot Fines" for visible violations (littering, mixing waste).
- Tier 2 (State): Pollution Control Boards (SPCB) levy "Environmental Compensation" (EC) for systemic failure (e.g., a housing society failing to process wet waste for months).
- Tier 3 (Legal): Continued non-compliance triggers criminal prosecution under the Environment (Protection) Act, 1986.
Spot Fines (Individual & Household Level)
Note: Exact amounts vary by Municipal Corporation (e.g., BMC vs. BBMP), but the 2026 Rules set these baselines.

3. Penalties for Bulk Waste Generators (BWGs)
For Housing Societies (RWAs), Malls, Hotels, and Offices.

4. Environmental Compensation (EC) Formula
For repeated offenses, the SPCB applies a formula rather than a flat fine.
EC = PI x N x R x S x LF
PI: Pollution Index (Severity of harm)
N: Number of days violation occurred
R: Rupee Factor (Base cost of remediation)
S: Scale of Operation (Size of your society/business)
LF: Location Factor (Higher fines for proximity to schools/hospitals)
Example: A large housing society dumps wet waste in an open plot for 30 days.
Calculation: ₹5,000 (Base) × 30 Days = ₹1.5 Lakhs penalty + Cost to clean the plot.
